The Fair Entitlements Guarantee (FEG) is a safety net scheme that operates to pay eligible employees their outstanding entitlements in the event of the insolvency of their employer.  The Recovery and Litigation Branch is responsible for administering the FEG Recovery Program, which is designed to strengthen the recovery of advances made under the FEG scheme. 

The FEG Recovery Program provides funding for liquidators of companies and trustees in bankruptcy (where FEG advances have been made) to pursue recovery proceedings, including litigation and other activities, to increase assets available to creditors in the winding up or bankruptcy process. Under the FEG Recovery Program, the Branch also manages a number of other actions brought directly by the Commonwealth to pursue recovery of advances and increase the return to the Commonwealth.

The Branch is looking for exceptional corporate and commercial lawyers with the enthusiasm and capacity to enter a niche field of government legal practice.

The Position

Whilst the successful candidates may have commercial dispute resolution litigation experience, perhaps with a background advising on corporate and personal insolvency, they must also possess excellent legal, analytical and conceptual skills, as well as an ability to quickly get up to speed on departmental systems and processes.

Under supervision, either individually or as a member of a team, the successful candidate will:

• Assist in managing a range of recovery actions intended to increase the return of FEG payments to the Commonwealth as a creditor of companies in liquidation.
• Liaise constructively with departmental and external stakeholders in relation to the work of the Branch.
• Work collaboratively to prepare correspondence and briefing material.
• Assist in providing legal advice on a range of commercial and insolvency matters.
• Contribute to policy development and legal reform relevant to the work of the Branch.
• Make meaningful contributions to an effective, high functioning team.
• Promote the principles and practices of workplace diversity, work health and safety and staff development and training.

Whilst experience briefing departmental secretaries and relevant ministers will be an advantage, experience settling complex legal advice, correspondence and briefing material in other settings will also be highly regarded.
