1.1 These Terms of Use (“Terms”) form an agreement between Beyond Law ABN: 18 958 826 121 (“Beyond Law”, “we”, “us” and “our”) and the Customer (“customer”, “the user”, “your” or “you”) in relation to your use of the website “beyondlaw.com.au” (the “Site” and “website”) and all and any postings, emails, messages and other communications made to or using the Site.

1.2 By using this website you are deemed to accept the following terms and conditions. If you disagree with these terms of use or any part of these terms of use, you must not use this Site.

1.3 We may change these terms of use at any time without notice. Any amendment will be effective immediately. Your use of this website after any amendment constitutes an agreement by you to comply with and be bound by the amended terms of use. Accordingly, you should read these terms of use from time to time for changes.

2. Privacy Policy

2.1 In accepting these Terms, you also confirm that you have read and accept our Privacy Policy.

3. Limited Liability

3.1 We make no warranties or representations about this website or any of its content. We do not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through the Site by us, our partners or any member or any other person or entity.

3.2 The Site is provided on an "as-is" basis and you agree that you are using the Site entirely at your own risk. Third party websites with links from the Site have not been verified or reviewed by us and use and access of such third party websites is made at the user’s own risk. The information, software, products, and services included in or available through the Site may include inaccuracies or typographical errors.

3.3 We are not responsible to you or anyone else for any direct or consequential loss suffered in connection with the use of this website. You acknowledge that we are not responsible for the conduct or activities of any user and that we are not liable for such under any circumstances.

3.4 We exclude, to the extent permitted by law, any liability which may arise as a result of use of this website. Certain rights and remedies may be available under the Competition and Consumer Act 2010 (Cth) or similar legislation of other States or Territories and may not be permitted to be excluded, restricted or modified. Apart from those that cannot be excluded, we exclude all conditions and warranties that may be implied by law.

3.5 By using the website, you agree to indemnify us for any loss or liability arising out of your use of this site. In no circumstances will we be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity, loss of anticipated savings or any other similar or analogous loss resulting from your access to, or use of, or inability to use the website or any content, or in any way relating to an experience itself (or the provision or non-provision of an experience), whether based on warranty, contract, tort, negligence, in equity or any other legal theory, and whether or not we knew or should have known of the possibility of such damage, to business interruption of any type, whether in tort, contract or otherwise.

3.6 We do not accept liability of any description for the posting of any unlawful, discriminatory, threatening, abusive, defamatory, obscene or indecent information, or material of any kind, including, without limitation, any material that would be criminal activity, or give rise to civil liability or breach any law. 

3.7 We encourage you to ask questions of any employer when applying for any advertised position about the employment conditions (pay, hours, expected duties, superannuation, tax etc.). We advise that you contact the Fair Work Ombudsman for further information about your rights at work. We do not accept liability for any inaccuracies or misinformation presented in advertised positions.

4. Third Party and Other Websites

4.1 As you browse through this website you may access other websites that are subject to different terms of use. When using these other sites, you will be bound by the terms and conditions posted on those websites.

4.2 We do not take responsibility for the content in, or currency of, any externally linked sites. The inclusion of any link within our site does not imply endorsement by Beyond Law of the linked external site, nor does it suggest any relationship with the organisation linked.

5. Copyright and Trademarks

5.1 If you wish to reproduce any of our content, you must first request our permission. If we grant permission, you must give appropriate attribution to the author, website link and date of first publication. 

5.2 We have moral & registered rights in its trademarks and you shall not copy, alter, use or otherwise deal in the marks without the prior written consent of Beyond Law.

5.3 You must not remove or obscure any copyright notices and other proprietary notices contained on the Site.

5.4 The names of actual companies and products mentioned herein may be the trademarks of their respective owners.

5.5 If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us written information containing information of the breach. It must include a statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf.

6. Access

6.1 Access to certain areas of this website may be restricted. We reserve the right to restrict access to other areas of our site, or indeed the whole site, at our discretion.

6.2 If we provide you with a username and password to enable you to access restricted areas of our site or other content or services, you must ensure that that username and password is kept confidential.

6.3 We have the right to disable any account, username or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

6.4 We cannot guarantee uninterrupted service and we do not give any promises or warranties (whether express or implied) about the availability of the Site. If we cannot do what we have promised in these Terms because of something beyond our reasonable control (including, without limitation, disputes involving our employees), you agree that we are not liable for this.

7. User Generated Content

7.1 In these terms of use, “your user content” means material (including without limitation text, images, audio material, uploaded files, video material and audio-visual material) that you submit to our sites, for whatever purpose. By posting, uploading, inputting, providing or submitting information, you warrant and represent that you own or otherwise control all of the rights to your information as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the information.  You also warrant that the information you submit is correct and truthful.

7.2 You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights. Your user content is bound by our Privacy Policy at all times.

7.3 Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or us or a third party (in each case under any applicable law).

7.4 You must not submit any user content to the site that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

7.5 We reserve the right to edit or remove any material submitted to our sites, or stored on our servers, or hosted or published upon our sites.

7.6 Notwithstanding our rights under these terms of use in relation to user content, we do not undertake to monitor the submission of such content to, or the publication of such content on, our sites.

8. User Registration

8.1 You may be required to register your details to be able to view or apply for jobs or to access content on the Site.

8.2 After registration, you agree that we may use your registered details to contact you in regards to any relevant jobs or employers that match your registration preferences.

9. Security

9.1 Beyond Law takes the security and the privacy of its users very seriously. The User agrees that the User shall not do anything to prejudice the security or privacy of our systems or the information on them.

9.2 Beyond Law shall do all things reasonable to ensure that the transmission of data occurs according to accepted industry standards. It is up to the User to ensure that any transmission standards meet the User’s operating and legal requirements.

9.3 Beyond Law shall perform backups of its entire systems in as reasonable manner at such times and intervals as is reasonable for its business purposes. We do not warrant that it is able to backup or recover specific customer data from any period of time unless so stated in writing by us.

10. Electronic Communication

10.1 We will send you notices and other correspondence to the details that you submitted to us upon registration. It is your responsibility to update your contact details as they change and ensure that your email provider does not block our communication, including spam filters and blacklists.

10.2 A consent, notice or communication under this agreement is effective if it is sent as an electronic communication unless required to be physically delivered under law.

11. Disclaimer

11.1 Beyond Law provides no warranties of any kind, express or implied, including, but not limited to, that if you are a business looking for employees that any suitable employees will be available or if you are a job-seeker seeking work that you will find any suitable employment or that a position advertised in a post is available.

11.2 Beyond Law does not act as agent for any employers, job-seekers or other users. 

11.3 Beyond Law does not endorse any of the posts, information, businesses or job-seekers on its Site and recommends that prior to entering into any agreement, that you obtain your own independent advice. It is your responsibility to assess the accuracy and completeness of the material on the Site. 

11.4 We cannot guarantee and do not promise any specific results from use of the Site.

11.5 Whilst we endeavour to ensure that the information on the Site is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the Site remains available or that the material on the Site is kept up-to-date.

11.6 We are not responsible if third parties do not fulfil their obligations or if they are unable to deliver their product or service.

12. Release

12.1 In the event that you have any claim or action against any other member arising from that member's use of our Site, you agree to pursue such claim or action independently of and without any demands from us, and you release us from all claims, liability and damages, arising from or in any way connected to the claim or action.

12.2 In the event that a claim or action is brought against us from your activities or use of the Site, including any breach by you of these Terms or any charges or complaints made by other parties against you, you agree to pay, hold harmless and defend us in the claim or action.

12.3 You also agree to cooperate as fully as reasonably required in the defence of any claim and allow us to assume the exclusive defence and control of the matter at our discretion.

13. Acceptable Use

13.1 You must not use the Site in any way that causes, or may cause, damage to the sites or impairment of the availability or accessibility of the Site; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

13.2 You must not use this Site to transmit or send unsolicited commercial communications.

14. Jurisdiction

14.1 We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, the laws of the State of New South Wales, Australia, govern this contract and you may only pursue a legal action or proceeding in relation to the Site or our Services in the State of New South Wales, Australia.

14.2 Use of the Site is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

14.3 You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Site as a result of this agreement or use of the Site.

15. Termination

15.1 We reserve the right, at our sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice.
